Joel Daniel is a partner at Stein Ray LLP, where he focuses on resolving domestic and international construction disputes. Mr. Daniel has represented all manner of construction industry clients and has extensive experience resolving complex construction disputes, as well as providing project legal consulting and contract drafting and negotiation services.  Mr. Daniel has handled disputes and transactional matters arising from major commercial, industrial, and infrastructure projects, including renewable energy projects in Illinois, Texas, Ohio, and West Virginia, cable-stayed and precast segmental toll bridges, public and private university buildings, rapid transit systems, roadways, major high-rise residential towers and mixed-use development projects, airport terminals, hotels, parking garages, a presidential library, a dry dock, a performing arts theater, a brewery, a sugar processing facility, a wastewater treatment plant, a municipal swimming and recreational center, and various federal government facilities.

Mr. Daniel’s experience includes domestic and international arbitration of construction disputes, including administered and non-administered proceedings under ICC, AAA, ad hoc and other rules. He has handled complex disputes involving defective design, delay and disruption, differing site conditions, wrongful termination, geotechnical and forensic investigation, contract interpretation and administration, payment disputes, design professional intellectual property, risk allocation, lien and bond claims, insurance coverage, land use regulations, collective bargaining agreements, partnership disputes, economic torts, and fraud claims, among other issues.

Mr. Daniel is admitted to practice law in Illinois and Texas.

Representative Engagements

  • Represented a joint venture in preparing a claim for over $1,000,000,000 in additional costs arising from its construction of a multi-billion-dollar infrastructure project.
  • Represented a joint venture between two of the world’s leading EPC firms in international arbitration of disputes alleging damages of more than $100,000,000 arising from a multi-billion-dollar cross-border infrastructure project.
  • Represented an EPC Contractor in arbitration arising from the design and construction of a toll bridge. The project owner asserted design and construction defect claims exceeding $100,000,000 against the EPC Contractor, and the EPC Contractor asserted claims for wrongful termination and additional costs and damages exceeding $35,000,000. The arbitration panel ruled in favor of Joel’s client, finding that the EPC Contractor had been wrongfully terminated and was the “prevailing party” for purposes of attorney fee-shifting. The EPC Contractor received a multi-million-dollar net award in its favor.
  • Represented structural engineers in complex, multi-party litigation arising out of collapse of public transit rail tracks. This matter was resolved through a mediated settlement, with Joel’s client paying only a small percentage of the overall global settlement amount.
  • Represented a joint venture in arbitration of its claim for delay damages exceeding $40,000,000 on a high-profile $800,000,000 project.
  • Represented a specialty electrical subcontractor in complex, multi-party arbitration arising from the construction of two major solar farm projects.
  • Represented a general contractor in litigation with a public owner arising out of roadway reconstruction project.
  • Represented an ENR top 5 design-build firm in connection with review and negotiation of manuscript contracts employing a variety of project delivery methods, including an airport renovation and various industrial and commercial projects.
  • Defended an architect against design defect claims brought by a condominium association, including achieving complete reversal of trial court’s award against architect.
  • Obtained summary judgment in favor of a design consultant based on application of economic loss doctrine and successfully defended summary judgment order on appeal.
  • Represented a surety in Chapter 11 bankruptcy of its publicly traded bond principal.
  • Represented a general contractor in arbitration involving claims for construction delay and nonpayment arising out of construction of a brewery and taproom in Chicago.

Education

Mr. Daniel received his J.D. from the University of Texas School of Law in 2013 and his B.A. from Dallas Baptist University in 2009. While in law school, he was a member of the Texas International Law Journal, and he spent a semester studying European and International Business Law at Université Jean Moulin Lyon III, in Lyon, France.
